These terms govern use of The Dealers website and services. They are designed for the non-transactional launch version of the service.

1. Operator

The Dealers is operated by IOAH, Société par actions simplifiée (SAS), 116 Avenue Parmentier, 75011 Paris, France, RCS Paris 938 704 830.

2. Purpose of the service

The Dealers lists dealers, markets and vintage furniture, lighting, decor, art and design pieces, provides discovery tools and may transmit buyer enquiries to dealers.

In the launch version, The Dealers does not collect the purchase price, provide escrow, conclude a sale on behalf of a dealer or organise delivery.

3. Dealer profiles and unclaimed profiles

The Dealers may create a professional profile from information supplied by the dealer or publicly available professional sources in order to build a specialist directory. An unclaimed profile does not imply a partnership, endorsement or contractual relationship with the dealer.

The relevant dealer may request review, correction, claiming, restriction of certain information or removal where there is a legitimate basis. The Dealers may request reasonable evidence to verify the requester’s identity or authority.

4. Listings and dealer content

Where content is supplied or approved by a dealer, the dealer remains responsible for the accuracy of the information provided and must hold the necessary rights to photographs, descriptions, trademarks and other published material.

The Dealers may edit presentation, structure data, moderate, suspend or remove content, particularly where it is manifestly inaccurate, unlawful, misleading, infringes third-party rights or is incompatible with the expected catalogue quality.

5. Buyer enquiries

When a user sends an enquiry from a listing, the contact details and message supplied are transmitted to the relevant dealer so they can respond. The Dealers does not guarantee the dealer’s response time or the availability of the piece.

6. Sale between buyer and dealer

Any sale is concluded directly between buyer and dealer. The dealer determines the final price, availability, payment, delivery or collection terms, applicable warranties and after-sales service. The dealer’s own terms of sale apply to the transaction.

The Dealers is not a party to the sale contract and does not replace the professional seller’s legal obligations towards the customer.

7. Prohibited use

  • use the service for fraudulent, unlawful or misleading purposes;
  • send spam, abusive automated messages or attempt to bypass technical protections;
  • mass-extract or reuse the catalogue by automated means without authorisation;
  • impersonate a dealer or third party;
  • publish or transmit content that infringes third-party rights.

8. Reporting and intellectual property

Anyone may report manifestly unlawful content, intellectual-property infringement, impersonation or a material error. The report should identify the relevant content and explain the reason for the request.

9. Availability and liability

The Dealers uses reasonable efforts to provide an available and reliable service, but does not guarantee uninterrupted operation. Catalogue information may change, particularly prices and availability supplied by dealers.

Nothing in these terms limits liability that cannot lawfully be excluded or limited. Subject to that rule, The Dealers does not assume obligations that belong to the seller in a transaction concluded directly with a dealer.

10. Personal data

Personal-data processing is described in the Privacy Policy.

11. Changes to the service and terms

The Dealers may change the service and these terms. A material change affecting registered users will be communicated appropriately where required by law.

12. Governing law

The service is operated from France and these terms are governed by French law, subject to any mandatory rules applicable to the user. Jurisdiction is determined in accordance with applicable law.
